The Game and its original content, features, and functionality are and will remain the exclusive property of StratArcade Inc. and its licensors. The Game is protected by copyright, trademark, and other laws of both Canada and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of StratArcade Inc.

6. USER CONTENT

The Game may allow you to create, post, share, or store content, including messages, text, images, and other materials ("User Content"). You retain any rights that you may have in your User Content.

By making any User Content available through the Game, you grant to StratArcade Inc. a non-exclusive, transferable, worldwide, royalty-free license, with the right to sublicense, to use, copy, modify, create derivative works based upon, distribute, publicly display, and publicly perform your User Content in connection with operating and providing the Game.

7. VIRTUAL ITEMS AND CURRENCY

The Game may include virtual currency or items that may be purchased with real money or earned through gameplay. You do not own these virtual items or currency; rather, you purchase a limited license to use them within the Game.

StratArcade Inc. reserves the right to manage, regulate, control, modify, or eliminate virtual items or currency at any time, with or without notice. StratArcade Inc. shall have no liability to you or any third party if StratArcade Inc. exercises these rights.

8. TERMINATION

We may terminate or suspend your account and bar access to the Game immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Game, or notify us that you wish to delete your account.

9. LIMITATION OF LIABILITY

In no event shall StratArcade Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Game.

The Game is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
